SIA “BK Komunikacijas”, Reg. No: 40203202309, address Riga, Mātera iela 15, LV-1014, hereinafter referred to as (“us”, “we” and “our”), provides the content available on the website www.loon.lv and provides services in accordance with the terms and conditions set out below, delivery terms, product return terms, other terms and conditions and operating policies, the presentation of which can be found on the Website, in connection with certain functions, elements or advertising, as well as provides customer service, and all of the above are included in these terms and conditions (collectively referred to as the Terms and Conditions) and are part of them, which are also referred to as our terms of sale (“Terms of Sale”).

SIA "BK Komunikācijas" reserves the right to change and modify these terms without prior notice and the user of the website assumes the responsibility to review all changes made when returning to this website. All changes made to these terms come into effect from the moment of their publication on this website. It is recommended to always familiarize yourself with our terms of sale before purchasing products. These terms were last changed on January 4, 2021.

PRICES, PAYMENTS AND PRODUCT AVAILABILITY

Once your order has been placed, you must pay the price indicated on our website as the purchase price for the relevant product. You should carefully check what is in your cart before making a purchase. We do not offer refunds for products purchased accidentally. Payment can only be made using the payment methods offered on our website. We will not ship the ordered products until we have received payment for the relevant products.

By placing an order in our online store, you warrant and represent to us that:

• You understand the nature and consequences of these terms and agree to be bound by them.
• You have the right and are legally permitted to purchase our products.
• You have the right and are legally permitted to make payments for the products you have ordered using your chosen payment method.
• The information provided to us in connection with your purchase is accurate and complete.

You agree to indemnify us against all expenses, losses or costs incurred in connection with any breach of the above warranties.

Loon reserves the right to refuse or cancel orders if there has been a disruption to the site or, for example, technical problems, an incorrect price is displayed, incorrect customer billing or shipping information has been entered, we have reason to believe that you are not authorized or legally permitted to make the relevant purchase, and we have reason to believe that you have violated these Terms.

Notification to the customer will be made immediately after we receive the information and all payments received from the customer will be refunded.

DELIVERY AND HANDLING INFORMATION

Orders are packed and shipped Monday through Friday only. Orders are shipped within 24 hours of order placement. Orders placed on weekends and holidays are shipped the next business day.

Delivery will be made to the delivery address you provide and it is your responsibility to ensure that the address is accurate. We are not responsible for delays and damaged or lost orders sent to incorrect, invalid or correct addresses. In the event that the product is lost due to the supplier, we will do our best to ensure that you receive your order.

Orders may be returned to us for various reasons, such as non-payment of fees, duties or taxes, incorrect customer address, customer not receiving the package from the post office, etc. If the order is returned or rejected, the customer must contact our customer service team to arrange a re-delivery and the customer will be responsible for all shipping costs. The purchased products will be delivered to you by delivery to the address you provided.

RETURN POLICY

If you believe the product has a manufacturing defect and would like an exchange or refund, please contact our customer service team to discuss the issue.

We cannot issue a refund if the product is not defective or if you have missed the money-back guarantee period. In the event of a manufacturing defect, you must contact our customer service team and describe the situation, preferably including pictures or a video showing the defect, within 30 days of receiving the product. We will review your application as soon as possible and, once we are sure of the defect, we will issue a refund.

WARRANTY

Yes, we believe in the quality of our products, therefore all our products come with a 2-year warranty from the date of purchase against all manufacturing defects. The date of purchase of the product is considered the day the Consumer accepts the relevant product.

Please note that the warranty does not cover:

Damage caused by improper use, lack of care (broken frames, arms or lenses), accidents, storing glasses outside the case provided for them;

Signs of natural wear and tear that occur after daily use (loss of shine on frames, scratches, loss of text, etc.)

OFFERS

If you have given us permission, we will send you marketing messages by email to inform you about our offers. From time to time, we may use your personal information to provide you with up-to-date information about offers of interest, changes in our organization, new products or services.

COLORS

We have made every effort to accurately represent the colors of our products that appear on the website, however the actual colors you see will depend on your display. We cannot guarantee that your display's color representation will be accurate.

External links are not under the control of SIA "BK Komunikācijas" and we are not responsible for the content of external links. SIA "BK Komunikācijas" provides these links to help you find the information you need more easily.

By using the services, products or features available on the www.loon.lv website, you acknowledge that Loon may transfer this information to third parties with whom SIA: BK Komunikācijas" cooperates to ensure a complete online store experience.

SIA "BK Komunikācijas" does not claim ownership of the materials you provide to www.loon.lv (including feedback and suggestions) or upload, input or submit to any Loon site or related services ("Submissions"). You agree that you will not use the www.loon.lv content, which can be accessed through www.loon.lv, in any country or in any manner prohibited by applicable laws, restrictions or regulations.

PRIVACY

We protect the fundamental rights and freedoms of natural persons, in particular the right to privacy, with regard to the processing of personal data in accordance with Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.

You may not transfer your rights or obligations under these Terms to any other person without our prior written consent.

FORCE MAJEURE

SIA "BK Komunikācijas" is not liable for any delay in the performance of obligations or their non-performance, or any other type of non-performance, caused by circumstances and obstacles beyond our reasonable control, including but not limited to strikes, government orders, hostilities or national emergency, terrorist threats or acts of terrorism, environmental or climatic anomalies, non-performance by third parties, disruptions in the Internet connection, as well as computer equipment and software failures. In the event of such force majeure circumstances, we will try to eliminate the resulting delays as soon as possible.
